Terms of Service

These general terms and conditions regulate legally binding all transactions that are processed through the online shop of MYCHEM.CH. Any other agreements or telephone or verbal agreements with the customer are only expressly recognized by us in writing.

Offer

MYCHEM.CH is a pure shop without a shop and deals with special articles and chemicals for the trade and the private household. Our offers are not binding. Small deviations and technical changes compared to our pictures or descriptions are possible.

Hazard statements / Minimal age

The minimum age for some chemicals is 18 years. These chemicals are labeled with an appropriate hazard symbol. In addition, the minimum age is described in the article text. The orderer confirms with his order that he has passed the age of 18 in this case. The goods will be sent to him by registered mail.

The buyer / buyer agrees in any case before the application of articles which are marked with danger symbols, which correspond to the safety instructions on the packaging and to read.

Delivery and payment

The delivery and payment conditions of MYCHEM.CH are described in detail during the ordering process. Special forms of delivery requested by our customers will be charged according to the local surcharge.

Ordered items will be shipped as soon as possible, subject to availability. Applicable delivery times can be found in the respective article. The delivery period is given in number of working days until handover to the post office. From then on, according to the Code of Obligations, the customer is responsible.

If an article is not available, we inform the customer immediately. If the failure to comply with a delivery or performance deadline is due to force majeure, unforeseeable obstacles or other circumstances beyond our control, the deadline will be extended accordingly. If the impossibility of delivery is due to inability of the manufacturer or our supplier, both we and the buyer can withdraw from the contract, if the agreed delivery date is exceeded by more than 3 weeks.

Payment Methods

(1) Sofortüberweisung / Klarna

When paying via Sofortüberweisung, you can pay via your e-banking login, with your bank, PostFinance Card.
This amount will be listed in the current order process.

(2) Purchase on account via Klarna Bank AB (publ), acting through its branch in Germany, Klarna Bank AB, German Branch

When purchasing by invoice, the amount invoiced at the latest by the due date indicated on the invoice form must be stated on the account of our external partner, Klarna Bank AB (publ), acting through its branch in Germany, Klarna Bank AB, German Branch, indicated in the invoice [Link to https://www.billpay.de/ch/endkunden- ch /], to pay. The payment method Purchase on account does not exist for all offers and requires, among other things, a successful credit check by Klarna Bank AB (publ), acting through its branch in Germany, Klarna Bank AB, German Branch. If you do not comply with your payment obligation, you will be in default of payment at the end of the payment period set without further reminder and will have to pay default interest of 8%. Klarna Bank AB (publ), acting through its branch in Germany, Klarna Bank AB, German Branch is entitled to charge a reminder fee of up to CHF 30.00 per payment reminder as well as other fees, in particular the costs for a possible collection procedure. (3) PostFinance Card

Payment with the well-tried Swiss PostFinance E-Finance

Pay with the PostFinance E-Finance and your order will be triggered immediately: Very fast processing time!

Here you can conveniently pay with your PostFinace E-Finance in the same way as e-banking in your usual Swiss way!
This process guarantees maximum safety for both!

If you continue the ordering process, you will be automatically redirected to Sofort GmbH, Klarna.
There you can log in with your card and release the payment as usual.
You will then come back to the shop where you will receive your order confirmation.
You receive the goods with this kind of payment without delay (as with normal advance payment).

(4) Advance payment within 5 days

If you prefer the traditional prepayment, you can transfer it to our bank account within 5 days. As soon as we confirm your payment we will release your order. If it is urgent you can email us your transfer slip.

Please note that your order means a legally binding purchase and is subject to the Obligatinenrecht. Payment delays cause costly reminders and default interest.

(5) PayPal

If you are a member of PayPal you can do your own easy, secure and very convenient payment. An ultrafast order processing.

(6) VISA

Payment with your VISA card

With VISA and your order is triggered immediately: Very fast processing time!

Here you can comfortably pay with your VISA card in your usual Swiss way!
This process guarantees maximum safety for both!

There you can log in with your card and release the payment as usual.
You will then come back to the shop where you will receive your order confirmation.

Payment with your MasterCard

With MasterCard and your order is triggered immediately: Very fast turnaround time!

Here you can conveniently pay with your MasterCard in your usual Swiss manner!
This process guarantees maximum safety for both!

There you can log in with your card and release the payment as usual.

Price calculation

(1) Minimum value of goods

For a value of less than CHF 17.00, a small quantity surcharge of CHF 6.00 may apply.

Packaging

The costs of the customary packaging are included in the order. If special packaging is required or required for the safe shipment of an item, the corresponding costs will be charged.

Cancellation / withdrawal / Illegal orders

Basically, there are no statutory right of withdrawal and return in Switzerland. As a rule, buyers cannot withdraw from a normal purchase contract.

resignation

Wrong goods ordered but not yet in shipping? In this case, please contact us as soon as possible. MYCHEM.CH grants you a voluntary right of withdrawal against a voucher if the ordered goods are not already packed and labeled (order amount minus 5% expenses of the payment worshiper).

Wrong delivery

The return must be in the undamaged original packaging.
In this case, the ordered goods will be delivered to the customer at no cost and the return postage for the incorrectly delivered goods will be refunded.

Return after correct delivery of goods, however incorrect addressing, undeliverability etc.

If the customer sends the parcel back for his own reasons or a parcel is sent back by the post office because the parcel did not reach the customer (wrong addressing, customer does not accept the peket etc.): After receipt of the originally packaged and intact goods, the goods will be returned -Calculation:

Credit of the goods costs (only undamaged goods)
- Payment provider costs: 5% (Billpay, Paypal etc.)
- Handling costs: 10% of the value of the goods, at least CHF 15.-
- Postage costs for the return to us
- Possible repair, disposal costs of the damaged goods

The remaining amount will be paid as a voucher

Illegal orders

In the shop there are items that may only be delivered to the trade (e.g. chemicals group 1). These are clearly declared as such.
People who still order such articles will be contacted by us.
If it turns out that the order has been placed unjustifiably, a corresponding voucher will be issued. Expenses and costs for this special treatment can be deducted beforehand.
Under no circumstances will money be returned, especially since we already had to pay the costs.

Benefit and danger

OR Art. 185: The benefits and risks pass to the buyer after the parcel has been returned to the post office.

Disclaimer

The liability of MYCHEM.CH, in particular the liability for auxiliary persons or for consequential damages, is excluded.

Complaints

False deliveries, quantity errors and identifiable defects must be reported in writing by the customer within 5 days of receipt of the goods. If the customer or third parties unauthorized interventions to the goods or parts thereof before, all warranty claims are forfeited unless the alleged defect is not related with the procedure.

Special processing

Manual processing of orders leads to considerable additional effort compared to the automatic process.
We charge a corresponding processing fee in addition to the automatically incurred fees.

Retention of title; On Bill; lien

(1) For consumers, we reserve the ownership of the purchased item until full payment of the invoice amount. Are you an entrepreneur in the exercise of your commercial or independent professional activity, a legal entity under public law or special fund under public law, we reserve the ownership of the object of sale until the settlement of all outstanding claims from the business relationship with the purchaser. The corresponding security rights are transferable to third parties.

(2) You are only entitled to set-off if your counterclaims have been legally established or are undisputed or recognized by us. In addition, you have a right of retention only if and to the extent that your counterclaim is based on the same contractual relationship.

(3) If the customer is in default of us with any payment obligations, all existing claims shall become due immediately.

Until the purchase price has been paid in full, including all incidental costs such as interest or shipping costs, the object of purchase and all its components and accessories are subject to retention of title within the meaning of Art. 715 ZGB.

data protection

Mychem.ch guarantees its customers data protection and security. The personal data is only used to process customers' orders. The address details and personal data will of course be treated confidentially and will only be used within the scope of the order and the applicable statutory data protection regulations. In the mychem webshop, the order is processed using an order form.
The information entered therein is used for the delivery of the order, for the order and delivery confirmation or invoice and for queries to the customers.

The e-mail address or telephone number of the customer will be passed on to the listed shipping service provider. This enables him to pass on status information on the delivery of consignments to the customer by email or SMS.

The regulation of the access authorizations to his registration data is the responsibility of the customer and is subject to his own duty of care. Mychem.ch is not liable for any damage that could result from access by unauthorized persons to the customer's order information. We meet the compliance requirements required by credit card issuers. Mychem.ch itself never saves credit card information.
